Rechtsregel

Aansprakelijkheid op grond van artikel 6:174 BW kan in alle gevallen waarin een opstal niet voldoet aan de eisen die men daaraan in de gegeven omstandigheden mag stellen, intreden. Daarbij gaat het om de eisen die men uit het oogpunt van veiligheid aan de opstal in kwestie mag stellen.   

De enkele omstandigheid dat een opstal in algemene zin voldoet aan alle veiligheids-voorschriften van bijvoorbeeld de brandweer of de arbeidsinspectie, brengt niet mee dat aansprakelijkheid op grond van artikel 6:174 BW is uitgesloten.
