Nietigverklaring huwelijk - Arrest

HR 26 april 2013, ECLI:NL:HR:2013:BZ8782 (Nietigverklaring huwelijk)

 

Casus:

Een man, geboren in juni 1986 en een vrouw, geboren in januari 1929 zijn in 2008 in gemeenschap van goederen getrouwd. Het Openbaar Ministerie verzoekt ex artikel 1:69 jo. 1:32 BW de nietigverklaring ervan. De rechtbank wijst dit verzoek na deskundigenonderzoek toe en verklaart de man daarbij niet te goeder trouw in de zin van artikel 1:77 BW. Het hof bekrachtigt deze beschikking. Het cassatieberoep van de man is gericht tegen beide beslissingen.

 

Hoge Raad:

De aangevoerde klachten kunnen niet tot cassatie leiden. Het beroep wordt zonder motivering verworpen.
