Oriënt heeft per ingang van 1981 een winkelpand gehuurd van rechtsvoorganger Trenning. In het pand heeft Oriënt een reisbureau gevestigd.

De vraag die in deze zaak luidt is of het reisbureau bedrijfsruimte is in de zin van art. 7A:1624 BW? Onder het begrip ‘kleinhandelsbedrijf’ wordt de detailhandel bedoeld. Om te bepalen of er in een concrete situatie sprake is van een ‘kleindhandelsbedrijf’ mag mede betekenis worden toegekend aan wat daaronder in het spraakgebruik wordt verstaan.
