Nederland heeft universele rechtsmacht voor de vervolging van zeeroof/piraterij. Indien Nederland op geen enkele wijze concreet betrokken is en berechting om die reden volstrekt niet voor de hand ligt en ongewenst lijkt, is niet de rechtsmacht in geding, maar de opportuniteit van de vervolging. Denkbaar is dat vervolging dan niet toelaatbaar is vanwege strijd met beginselen van een goede procesorde.
