De Hoge Raad stelt zelfstandige aanknoping van de voorvraag voorop, maar laat de mogelijkheid van afhankelijke aanknoping van de voorvraag open, indien de samenhang tussen de hoofd- en voorvraag daartoe dwingt. (Vgl. artikel 10:4 BW.)
